The full award is half a month’s wage for each of the first five years and a full month’s wage for each year after, with part of a year counted in proportion to the time worked (Article 84).
Example: seven years of service earn (5 × half a month) + (2 × one month) = 4.5 months of wage.
A worker who resigns before two consecutive years of service receives no award.
They receive one third of the award for at least two and not more than five years, two thirds for more than five but under ten years, and the full award from ten years.
When the worker leaves because of force majeure beyond their control, or when a female worker ends the contract within six months of her marriage or three months of giving birth.
A worker also keeps all rights when leaving in the cases set out in Article 81, such as the employer failing to meet its essential obligations.
When the worker is dismissed in one of the cases set out in Article 80, such as assault or a serious breach of obligations, or resigns before completing two years.
The last actual wage: basic salary plus the fixed allowances the worker receives, such as housing and transport.
